"This will be one of the most interesting and important cases ever tried." So said Judge Sim Lake to about 100 prospective jurors. The Enron trial, with Ken Lay and Jeff Skilling as defendants, has been hyped up like a major sports event, complete with lots of pre-trial articles about every aspect that could be covered in advance. Rightly or wrongly, this will be the defining moment of the most recent era of corporate fraud. Who wins will, to a large extent, define who fared better through the era--the executives who allegedly perpetrated massive crimes or the prosecutors. Finally, it is underway.
