Moynihan's bar status questioned

The hits keep coming for Bank of America (BAC). The New York Post reports that Brian Moynihan was named general counsel on Dec. 10, 2008, "but was not technically allowed to offer crucial legal advice until more than a week later, when he re-activated his status with the Massachusetts Bar Association." The upshot of that revelation, if true, is unclear.

It's entirely possible to be employed as general counsel of a bank and not be a member of the Massachusetts Bar. Still, it sort of looks odd. And it has raised questions from congressional investigators, who are looking into disclosure and other issues regarding Bank of America's controversial deal to buy Merrill Lynch. There may be some politics at work.

This may have been intended as a strike at Moynihan, who is seen as one of two internal candidates for the CEO job. Conspiracy theorists may want to blame the North Carolina faction, which supports Greg Curl for CEO, for such a leak.
