Did Merrill Lynch mislead Congress?

New York AG Andrew Cuomo's war to expose the recipients of Merrill Lynch's ill-timed bonuses is not abating. The Financial Times reports that Cuomo is now accusing Merrill Lynch of misleading a congressional committee "about the timing of its decision to move up the payment of 2008 bonuses to December, just days before the company was acquired by Bank of America."

A letter to Rep. Henry Waxman stated incentive compensation decisions are made "at year end" and that such decisions for 2008 had not been made. Cuomo says while incentive decisions had not been made, the board decided on November 11 to accelerate bonus payments, and finalized the plan a month later. Cuomo is still pressing a court to reveal the names of executives who received bonuses, and Bank of America is still balking.
