Biovail's battle with SAC winding down?
Those who think that Biovail was wronged by hedge fund SAC Capital Advisors and its controversial research firms Gradient Analytics have not fared well in court. The latest: A New Jersey Superior Court judge has dismissed a suit filed by Biovail back in 2006 saying that the court lacked jurisdiction, reports the New York Times. He did not rule on the legitimacy of Biovail's claims.
The dismissal follows a previous dismissal of a shareholder suit by a federal judge, who ruled that "Biovail had violated numerous ethics rules including by ghostwriting the shareholder lawsuit in order to obtain documents and other materials" that could be used in a separate racketeering case. Biovail is seeking to put a number of legal issues behind it. So this may be the last word.
