Bernard Madoff may not need his day in court after all. One piece of news from the hearing on his bail was that his lawyer, Ira Lee Sorkin, is "engaging in discussions concerning a possible disposition of this case," reports the New York Times. You would think this will include some substantial jail time, as this is considered the biggest Ponzi scheme in U.S. history. You would also think that any settlement would include some sort of agreement to help investigators piece together exactly how the scam was engineered. Stay tuned. My sense is that Madoff doesn't have much choice. The issue is: How hard will the government play?
