Madoff to stay out of jail

Despite a big effort by prosecutors, a judge has ruled they failed to make a strong enough case that keeping Madoff free on bail represents a significant economic harm. As such, Madoff will be able to stay out of jail but confined to his home. Many alleged victims are outraged. One lawyer of investors told the AP, "There is a thirst for blood that transcends just those who have been victimized. There is a feeling...that folks like Bernard Madoff get a different brand of justice than the guy in the street."

It's unclear if prosecutors will appeal the decision. There is ostensibly a lot of tension still, and it raises the issue of just how much cooperation Madoff is providing. Separately, a magistrate extended the deadline to indict Madoff until Feb. 11. As well, another judge has given the main trustee the right to issue subpoenas to investigate the alleged scam as it liquidates the Madoff fund.
